Spacious Sorrento Retreat Booking Terms

TERMS AND CONDITIONS

 

Please read these terms and conditions carefully. By making a booking, you accept all booking terms and conditions. Please ensure that all the details of your booking are correct, and inform us of any errors or discrepancies within 48 hours of booking.

CHECK IN/CHECK OUT:

Check-in is available from 4pm on the day of arrival. The front door of the property is secured with a keypad lock. You will be sent the code a few days prior to your arrival. Check-out time is by 10am on the day of departure. We are happy to accommodate an earlier check in or later check out if possible, but cannot guarantee this.

NUMBER OF GUESTS:

At no time during your occupancy is the number of guests staying to exceed the number booked, unless prior approval is provided. The property is only available for use by guests booked to stay at the property. Overcrowding or breaches of this condition will render the booking invalid and may result in termination of the booking without refund.

PARKING:

We provide parking for 4 cars on the driveway of the property. Mornington Peninsula Shire prohibits carparking on the nature strip.

INTERNET:

We provide free Wi-Fi internet for guests only. The connection of the internet during the stay is not guaranteed and may be disrupted or not available without notice.

ADDITIONAL CHARGES:

A credit card authorisation must be provided upon confirmation of your booking. Any damage, loss or expense incurred as a result of breach of these terms & conditions will be charged against your credit card. Examples include but are not limited to breakage, loss, damage, failure to follow house rules leading to a complaint from Council or excess cleaning requirements. A fee will be charged for soiled mattresses and/or smells of cigarette smoke inside any building.

An extra cleaning fee of $150 will be charged if the property is left in an extremely dirty condition. Guests are expected to wash up all dishes and leave kitchen equipment as found at check-in.

LOST KEY POLICY:

Keys that are not returned at time of check-out will be charged at a cost of $25. This will be charged to the credit card held as the bond. 

PETS:

Pets (no cats) are permitted on the grounds of the property only by prior arrangement with Fingal House. Please note that the property is largely unfenced, and we cannot guarantee the safety of your pets should they wander around the property.

NOISE POLICY:

After 11pm each night, all noise is to be kept inside with doors closed. Spacious Sorrento Retreat is intended for holiday purposes or corporate offsite meetings only. Parties and events are strictly prohibited without prior permission from management. Disturbance to our neighbours beyond 11pm on any night of the week will result in a penalty of $1000 charged to the credit card on file and may result in termination of the booking without refund.

SCHOOLIES POLICY:

Spacious Sorrento Retreat does not accept Schoolies reservations. Any reservations booked on behalf of a schoolies group or otherwise obtained by fraudulent means will result in immediate termination of the accommodation, eviction and a $1000 penalty charged to the credit card on file.

SMOKING POLICY:

Smoking is permitted in the garden. Please use the ashtrays provided to dispose of cigarette butts. There is to be no smoking inside the house.

Any traces of residual smoke inside the house will incur an additional cleaning charge of $250. Any additional costs for cleaning of lounges, cushions etc may be added where necessary.

LENGTH OF STAY:

Minimum length of stay restrictions apply. There is a standard 2-night minimum stay on weekends; a minimum 3 night stay on designated long weekends; and a 5 night minimum stay in the peak period over Xmas and New Year.

RATES:

Rates quoted are in Australian dollars and are subject to change at any time and availability. 

PAYMENT POLICY:

To secure your booking, you must pay a deposit of 50% of the total of the booking. The remaining 50% is due 14 days before your arrival date.

Spacious Sorrento Retreat accepts major credit cards and direct bank transfers.

Valid credit card details will be held as bond for your stay.

CANCELLATION POLICY:

Spacious Sorrento Retreat is a small business and cancellations affect us greatly. We will refund a cancellation if the dates are rebooked by us to another guest for the same value across the same dates. Should Government imposed travel restrictions due to COVID-19 mean travel is not possible, we will cancel your booking and refund any payments made, or rebook for future dates.

MORNINGTON PENINSULA SHIRE COUNCIL:

Fingal House operates under the guidelines set out under the Mornington Peninsula Shire Council Short Stay Accommodation Law. The Council has put together a Code of Conduct that all guests must adhere too. Failure to adhere to the Code of Conduct will result in a $1000 penalty charged to the credit card on file and may result in termination of the booking & eviction from the property.

SECURITY CAMERAS:

Spacious Sorrento Retreat operates 2 security cameras to protect the property, and to ensure that the outdoor curfew imposed by the Mornington Peninsula Shire Council is adhered too. Cameras are situated outside only.

PRIVACY POLICY:

Spacious Sorrento Retreat is subject to the National Principles in the Privacy Act 1988. We will collect personal information about you directly from you when you communicate with us over the phone or by email. The type of personal information collected by Spacious Sorrento Retreat may include your name, address, telephone number and email address. We may use your personal information to send marketing materials & monitor the service provided to our guests. If you send emails to Spacious Sorrento Retreat that contain confidential information, you do so entirely at your own risk.

CODE OF CONDUCT FOR SHORT TERM RENTAL ACCOMMODATION

PART 1 INTRODUCTORY

This Code of Conduct is the Short Stay Rental Accommodation Code of Conduct of the Mornington Peninsula Shire Council.

  1. 1.2  Objectives of this Code of Conduct are to:

    (a) Specify the minimum required operating standards, presentation and use of short stay rental accommodation within the Municipal District of the Mornington Peninsula Shire Council; and

    (b) Include all short stay rental accommodation as defined by the Local Law.

  2. 1.3  Authorising provision

    This Code of Conduct is made under the provisions of the Short Stay Rental Accommodation Local Law 2018 which is made under section 111 of the Local Government Act 1989.

  3. 1.4  Operational date

    This Code of Conduct comes into operation on 17 May 2018.

  4. 1.5  Revocation date

    This Code of Conduct ceases to operate on 17 May 2028, unless sooner revoked by Council.

  5. 1.6  Application of this Code of Conduct

    This Code of Conduct applies and has operation throughout the whole of the Municipal District.

  6. 1.7  Definitions

    Unless the contrary intention appears in this Local Law, the following words are defined to mean:

MEANING

Any change in the terms of the application details that affects the obligations of the parties is material

Has the same meaning as in the Road Safety Act 1986

Means the Municipal District of Council A notice served under clause 4.2

Means a person who occupies short stay rental accommodation for short stay purposes

Means the owner of the dwelling or appointed agent/property manager

Means freedom from disturbance; the state of not being annoyed by noise or unwanted actions

Has the same meaning as the Sentencing Act 1991

Short Stay Rental Accommodation registered under this Local Law

Means registration under and for the purposes of this Local Law

Means the fee for registration that is imposed by the Council under the Council’s fees and charges at the time

Means accommodation for no more than 30 consecutive days or 1 month in a dwelling for commercial gain, excluding other accommodation premises required to be registered under alternate legislation

PART 2 STANDARD OF MANAGEMENT

2.1. Standard of Management

  1. 2.1.1  The owner must display and make the Code of Conduct available to all occupants and visitors to the dwelling including availability on their website or any social media used by the owner to promote the short stay rental accommodation dwelling, and must incorporate the Code of Conduct provisions into rental terms and conditions.

  2. 2.1.2  The owner must control and be responsible for the behaviour of occupants and residents at the dwelling.

    Unacceptable behaviour includes loud:

(a) Aggressive behaviour;

  1. (b)  Yelling, screaming and arguing; and

  2. (c)  Cheering, clapping and singing.

  1. 2.1.3  Off street parking must be provided for all occupants’ motor vehicles. The owner must provide information to occupants on parking arrangements prior to arrival.

  2. 2.1.4  Additional accommodation is not allowed on site by way of tents, caravans, campervans or similar facilities.

  3. 2.1.5  Outdoor areas including swimming pools, spas, outdoor decking and balconies are not to be used between 11.00 pm to 7.00 am.

  4. 2.1.6  The owner must inform occupants of waste disposal arrangements and remove any excess waste left by occupants.

    PART 3
    STANDARD OF PRESENTATION

3.1 Presentation required

The owner of a Short Stay Rental Accommodation dwelling must maintain any land connected to the dwelling in good condition.
